Rax AI assumes no liability for any damage, data loss, security breach, system failure, financial loss, or other harm arising from the use, execution, or deployment of AI-generated code or technical outputs.

RAX AI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: • WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. • WARRANTIES OF ACCURACY, RELIABILITY, COMPLETENESS, OR NON-INFRINGEMENT. • WARRANTIES RELATED TO THE PERFORMANCE, AVAILABILITY, OR UPTIME OF THE SERVICE. • WARRANTIES THAT AI OUTPUTS ARE FREE FROM ERRORS, BIAS, OR HARMFUL CONTENT. • WARRANTIES THAT THE SERVICE WILL MEET YOUR BUSINESS OR TECHNICAL REQUIREMENTS. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN FULL. IN SUCH CASES, WARRANTIES ARE LIMITED TO THE MINIMUM EXTENT REQUIRED BY APPLICABLE LAW.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAX AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY: • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. • LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS. • BUSINESS INTERRUPTION OR LOSS OF BUSINESS INFORMATION. • REPUTATIONAL HARM ARISING FROM USE OF OR RELIANCE ON AI-GENERATED OUTPUTS. • DAMAGES ARISING FROM RELIANCE ON ANY INFORMATION, ADVICE, OR CONTENT FROM THE SERVICE. • DAMAGES ARISING FROM YOUR FAILURE TO SECURE YOUR ACCOUNT OR API KEYS. • ANY OTHER ECONOMIC OR NON-ECONOMIC HARM. THIS LIMITATION APPLIES WHETHER THE LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF RAX AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, RAX AI'S MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE FEES PAID BY YOU IN THE PRECEDING TWELVE (12) MONTHS OR USD $100.
By using the Service, you agree to defend, indemnify, and hold harmless Rax AI and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, losses, damages, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: • Your use or misuse of the Service or AI-generated outputs. • Your violation of these disclaimers, our Terms of Service, or any applicable law. • Any decisions, actions, or reliance based on AI-generated content. • Any content you submit, post, or transmit through the Service. • Any infringement of third-party rights caused by your use of the Service.
Rax AI operates from Kenya and makes no representation that the Service is appropriate or lawful for access or use in all jurisdictions. If you access the Service from outside Kenya, you do so at your own risk and are solely responsible for compliance with applicable local, national, and international laws. Users are prohibited from using the Service in ways that violate applicable laws or export control regulations. Rax AI expressly disclaims any liability arising from your failure to comply with local laws when accessing the Service from jurisdictions where it may be restricted. This Disclaimer shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising under or in connection with this Disclaimer shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
